These Terms of Service govern your use of the Herbert ERP platform ("the Service"), operated by Each Other Care Ltd. By accessing or using the Service, you agree to be bound by these terms.
Herbert is an enterprise resource planning system designed for residential care providers. The Service includes resident management, care planning, workforce management, billing, and compliance tools.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share login details or allow unauthorised access to the Service.
The Service processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Each Other Care Ltd acts as a data processor on behalf of care home operators (data controllers). For full details, see our Privacy Policy.
You must use the Service only for its intended purpose of managing care home operations. You must not attempt to access data belonging to other organisations, reverse engineer the Service, or use it for any unlawful purpose.
All intellectual property rights in the Service belong to Each Other Care Ltd. Your data remains your property. We claim no ownership over data you enter into the Service.
To the fullest extent permitted by law, Each Other Care Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
